Terms and Conditions

1. Introduction

Welcome to Estapick, a digital real estate platform operated by Estapick SH.P.K. ("Estapick"). These Terms and Conditions ("Terms") govern your access to and use of our website, mobile application, and related services (the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms and our Privacy and Cookie Policy. If you do not agree, you may not access or use the Platform or Services.

2. Scope of Services

Estapick provides an online platform where users can post and manage property listings, receive verified leads, access subscription-based tools, and promote services through advertising or sponsorship packs. The Platform serves real estate agencies, property developers, partners, and individual users. Estapick does not provide financial, legal, or professional advice.

3. Eligibility and Registration

To use paid or professional services, users must be legally registered businesses or individuals aged 18+. Accurate registration and licensing information must be maintained, and account sharing is prohibited. Estapick may suspend or terminate accounts failing verification or violating these Terms.

4. Listing and Lead Terms

Registered users may post property listings (Pay Per Listing – PPL) and receive leads (Pay Per Lead – PPLi). Listings must be accurate, comply with applicable laws, and be updated within 24 hours of any change. Estapick may reject or remove misleading or non-compliant listings. Lead disputes must be reported within 3 days of receipt, and Estapick's decision is final.

5. Payment Terms

All fees must be paid as per the selected plan or service. Late payments incur 1.5% monthly interest. Subscription fees renew automatically until cancelled. Refunds may be granted at Estapick's discretion. Prices exclude applicable taxes, and users bear all bank transfer costs.

6. Prohibited Uses

Users must not copy, reverse-engineer, scrape, or misuse the Platform. Illegal, discriminatory, or misleading content, malware, impersonation, and competitive use are prohibited. Violations may result in termination without refund.

7. Intellectual Property

The Platform and all associated content are owned by Estapick SH.P.K. Users grant Estapick a non-exclusive license to display submitted content (e.g. listings, images, or logos). Users warrant they own or have rights to their content and indemnify Estapick against any infringement claims.

8. Data Protection and Privacy

Estapick complies with Law No. 06/L-082 on Personal Data Protection and GDPR (where applicable). Personal data is processed for account management, lead generation, analytics, and marketing. Users may contact Estapick's Data Protection Officer at info@estapick.com to exercise data rights (access, correction, deletion).

9. Limitation of Liability

Estapick is not liable for indirect or consequential damages. Total liability is limited to the greater of the amount paid in the past 6 months or €100. Estapick is not responsible for outages, third-party attacks, or data loss caused by external factors.

10. Indemnification

Users agree to indemnify and hold harmless Estapick and its affiliates from any losses, claims, or damages arising from user content, breach of these Terms, or unlawful activity.

11. Termination and Suspension

Estapick may suspend or terminate accounts for non-payment, prohibited use, or breach of Terms. Outstanding fees remain payable upon termination, and Estapick may retain certain data as required by law.

12. Force Majeure

Estapick is not responsible for service delays or failures caused by events beyond its reasonable control, including natural disasters, war, strikes, or internet outages.

13. Dispute Resolution and Governing Law

These Terms are governed by the laws of the Republic of Kosovo. Disputes shall be resolved through written notice, negotiation within 10 days, and, if unresolved, through the competent courts of Prishtina, Kosovo.

14. Modifications

Estapick may revise these Terms at any time. Continued use of the Platform after updates constitutes acceptance of the revised Terms. Major changes will be communicated via email or Platform notification.

15. Language and Entire Agreement

These Terms are provided in English and Albanian. In case of inconsistency, the English version prevails. These Terms, together with the Privacy Policy, form the entire agreement between Estapick and the user.
